Assault Charges

There are different levels of assault in Colorado; First, Second, and Third Degree Assault. They all vary based on the intent of the assault, whether or not a deadly weapon was used, and  the level of injury to the victim. We’ll look at 2nd Degree Assault specifically today. In order to be arrested for Second Degree Assault, the person must have had the intent to cause bodily injury to the victim, and then caused the injury using a deadly weapon. It can also be charged when a person recklessly causes serious bodily injury to another person by using a deadly weapon. The definitions of “deadly weapon,” “bodily injury,” and “serious bodily injury” are all different and specific. This crime is also charged often when a police officer is injured – but when  police officer is involved, no real injury has to occur.

Assault Charges Often Lead to an Arrest

Because our government takes assault charges seriously, the person accused of assault will likely be arrested. Assault is common in bars after people have been drinking heavily, or in tense situations where people lose their temper and lash out. In situations like this, observers of the fight usually call the police. Once they arrive, the aggressor is arrested and taken to jail, where he or she will be booked (this includes fingerprinting, the mug shot taken, and a background check completed). At this point, it is important that the arrestee arrange to post bail, or else he or she will sit in jail. The best option is to speak with a bail agent to obtain a release using bail bonds. Friends and family members often work with the agent to arrange bail and get their loved one released.
