Why Bail Bonds aren’t Refundable

The simplest answer to this question is this: bail bondsman can’t refund bail bonds because of liability. When you sign a contract with a bail agent, you are agreeing to pay a small percentage (usually 10-15% of the full bail amount) instead of the full bail amount. In exchange, the bail bondsman is assuming the responsibility for the defendant. If the arrestee fails to return to court for all their court dates, the bondsman will have to forfeit the full amount of bail they provided. Obviously, this is a big risk when you work with many different clients.

Paying for a Service

Bail bonds aren’t refundable, because you’re paying for a service. You don’t have to come up with a large amount of cash (bail amounts can be extremely high). Instead, the bail agent is promising the court to pay the full amount should the defendant skip bail. This is a service they are providing.
